Figure 5.2 is a diagram illustrating a three-stage process of resolving disagreement between the parties over regional investment agreements. The IPPC is shown providing mediation and expert third-party determination functions. The first stage shows a normal process of the parties attempting to resolve disagreements about investment agreements or delivery plans on their own. The second step shows the IPPC providing mediation if the parties are unable to resolve disputes through normal processes and it is elevated to the IPPC, which plays a non-binding independent mediator role. The third stage shows the IPPC providing agreed expert determination, with both parties agreeing to be bound by the decision of the IPPC where previous stages have not succeeded in resolving disputes.
