“I am requesting the NIAA's Senate Estimates briefing pack, including background Briefs that were used for the October and November Senate Estimates period.

To assist in my request I am requesting finalised briefs (including “back pocket” or background briefs) given to the CEO, Deputies and the Minister or representative Minister in relation to the NIAA.”

1. A list of Aboriginal Groups whose royalties make up the Aboriginal Benefit Account and what are their values.

2. How many successful Aboriginal and Torres Strait Islander applications have applied for funding from the ABA and what are their values.

3. The number of successful non-Indigenous applicants who applied for funding from the ABA and what their values are.

The last five years are sufficient.

1. The final report commissioned by the National Indigenous Australians Agency (NIAA) to explore how to boost the social and economic benefits from gas development in the Beetaloo Basin for First Nations people.
2. All documents sent to and from NIAA's Minister and the Minister's office that refers to the report, both before and after its completion, including correspondence that discusses the report's cost and plans to release the report or not release the report, during the time period 1 October 2021 to 30 March 2022.

1. A copy of the deed between NIAA and KPMG dated 26 October 2015 (and any amendments thereto). To assist you, I note that this deed is mentioned on page 11 of the KPMG Report titled Aboriginals Benefit Account dated 11 February 2021 that was recently provide to a Senate Estimates Committee by NIAA.
2. A copy of all invoices submitted to NIAA by KPMG under that deed in relation to the preparation of the above mentioned report.
3. A copy of all invoices submitted to NIAA by KPMG (either under the deed mentioned above, or separately) since July 1 2020 in relation to any other matters related to the Aboriginal Land Rights (Northern Territory) Act 1976.

a copy of all briefings and advice to the Minister or his Office by the NIAA since July 2020 relating primarily to policy proposals for the amendment of the Aboriginal Land Rights (Northern Territory) Act 1976 (ALRA).

  • refers to the ALRA amendments in passing or as background information; or
  • is largely procedural in nature relating to the ALRA amendments;
  • Excluding briefings or advice in relation to Ministerial correspondence (including which may require external consultation or approval to enable release); and
  • Excluding other materials that would require consultation with or approval from organisations or entities external to the Commonwealth to enable their release.”

1. Copies of the title and contents pages of each and every consultancy report commissioned by or for the Indigenous Reference Group since its formation in 2017. In each case, I seek a copy of the most recent draft provided to the IRG and/or the Department (even if the report was not finalised). Information I seek includes the pages listing the title of each report, the contents page if one exists, the consultant and/or author(s), and the date of finalisation or submission of each report to IRG or the Department.
2. Copies of invoices submitted by the consultants to the IRG (or its agent) and/or the Department.
3. Copies of all documents providing formal recommendations made to the Government by the IRG since its inception in 2017.

• the terms and conditions of these appointments
• their commencement and termination dates
• whether the appointments made have now expired
• whether any extensions or renewals have been granted since initial appointments were made.”
